Before using our Services (as defined below), please read these Terms of Service and our Privacy Policy carefully to understand what they entail, as well as how we collect and use data. Together, these documents are referred to as the “Terms.” All of the Services we offer you through our website, mobile application, and other platforms are subject to these terms. The use and limitations of each of our Services, the extent of our liability to you, and your and our rights and obligations with regard to the provision and use of the Services are all described in full in these Terms.

1 Who We Are

• Welcome to In-Med Prognostics. The following terms and conditions (hereinafter referred to as “Terms and Conditions”) form part of the agreement between you and In-Med Prognostics (hereinafter referred to as “In-Med”, “we”, “our” or “us”), the operator of a platform that gives you, (hereinafter referred to as “you”, “your” or “User”), access to our various AI-based diagnostic tools like the brain volume calculator, preventive screening tools and any related services.
• The Website, the screening Tools, including any software, services, or other technology the Website and the screening tools are respectively based upon, is hereinafter called the “In-Med AI Studio”.
• The In-Med AI Studio is operated by In-Med Prognostics Pvt. Ltd., a company founded in India, with its registered office at 300, NCL Innovation Park, Dr. Homi Bhabha Road, NCL Colony, Pashan, Pune, Maharashtra, India – 411028.
• If you wish to contact us, please do so by filling up the form available on the Contact page on this website.
• You must be at least 18 (Eighteen) years old if you wish to use the InMed Platform. If you are under 18 years old, usage of the In-Med AI Studio and your agreement to these Terms and Conditions require the consent of your legal guardian.
• Your use of the full functionality of the In-Med AI Studio requires your agreement to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, you may not use or access any part of the In-Med AI Studio.
• Contract languages are English.

 

PLEASE NOTE THAT THE IN-MED AI STUDIO DOES NOT MAKE ANY MEDICAL DIAGNOSIS. PLEASE SEEK THE ADVICE OF A MEDICAL PROFESSIONAL IF YOU ARE CONCERNED ABOUT YOUR HEALTH. IN CASE OF AN EMERGENCY, YOU SHOULD CONTACT THE EMERGENCY SERVICES IMMEDIATELY. ALWAYS CONSULT YOUR DOCTOR OR ANOTHER QUALIFIED HEALTHCARE PROVIDER IF YOU HAVE ANY QUESTIONS REGARDING ANY MEDICAL ISSUES.

 

YOU SHOULD NEVER DISREGARD A DOCTOR’S PROFESSIONAL ADVICE OR CANCEL
AN APPOINTMENT WITH A DOCTOR BECAUSE YOU ARE RELYING ON INFORMATION YOU HAVE READ OR HEARD IN THE IN-MED AI STUDIO.

2. The legal relationship between you and In-Med
   • These Terms and Conditions apply to the use of the In-Med AI Studio and contain the terms governing your use of the In-Med AI Studio. It is important that you have read and understood the present Terms and Conditions, in conjunction with our Privacy Policy before using the In-Med AI Studio. If you have difficulty understanding any aspect of these documents, please contact us at https://inmed.ai/contact-us/ and we can explain what it means for you.
   • You may agree to get exclusive updates about In-Med if you agree to these Terms and Conditions. If you do not agree to these Terms and Conditions, you join us on the In-Med AI Studio.
3. The In-Med AI Studio
   • The In-Med AI Studio offers you the opportunity to find out what might potentially be causing your health issues. The In-Med AI Studio uses a medical knowledge base to suggest possible causes for your symptoms (hereinafter referred to as the “Assessment Report”).
   • Please be aware that we provide the In-Med AI Studio solely for information purposes. It is not a medical consultation. The In-Med AI Studio is not a suitable substitute for medical advice obtained from your doctor, general practitioner, or other health service provider.
   • The In-Med AI Studio does NOT provide diagnoses for medical conditions, nor does it prescribe how you are to treat any medical issues you may have. This can only be done by consulting a medical professional.
   • Ultimately, if you do have any medical issues related to the information that you entered in the In-Med Platform, you are responsible for whether or not you decide to consult a medical professional and/or seek medical advice.
4. Termination of our contractual relationship
   • In the event that you feel that you can no longer agree to the present Terms and Conditions or the Privacy Policy, at any time, you agree to stop using the In-Med AI Studio immediately.
   • You are entitled to stop using the In-Med AI Studio at any time and to terminate your agreement with In-Med, including if you do not agree with the changes to the In-Med AI Studio or these Terms and Conditions we proposed. You can choose to unsubscribe to the latest updates about us by removing your ID from our email list.
5. Our promise to you
   • Any information on the symptoms stated by you that is made available to you in text form via the In-Med AI Studio – as a statement made, is for information purposes only. The information is made available by In-Med as is, without warranty, guarantee, or representation of any kind.
   • You should not take any action based on the information provided in the In-Med AI Studio without consulting a doctor or other medical professional first.
   • Due to the nature of the internet and the given technology, we are unable to promise that you will be able to use the In-Med AI Studio at all times without any interruption, delay or faults and that the In-Med AI Studio will at all times meet your expectations. We can therefore assume no obligation with respect to the performance or availability of the In-Med AI Studio in these present Terms and Conditions. We expressly exclude any strict liability that may be applied by enforcement of law due to defects of the In-Med Platform
     existing at the time the agreement on the use of the In-Med AI Studio between you and us was concluded.
6. Third-party service
   • If, and to the extent that, our In-Med AI Studio contains links to other websites or resources operated by third parties, these links are to be deemed as being provided for your information only.
   • We are unable to influence the content of such websites or resources provided by third parties, and we may not be held liable for the content of information or websites linked included in frames. We may not be held liable for any financial or physical damages that you may incur as a result of, or in connection with, the use of such websites or resources.
7. In-Med AI Studio updates
   • We are constantly updating and improving the In-Med AI Studio. We constantly strive to provide you with innovative new services and features. We also make improvements and updates in order to stay abreast of changing technologies, behaviours, and the way in which people use the internet.
   • We reserve the right to change a specific aspect of a specific feature by updating the In-Med Platform, resetting that feature, and suspending the service or support for that feature. These changes may affect your activities on the In-Med AI Studio. Changes may include the removal, modification, or reset of the features you use. We will inform you of the changes and your rights in the case of changes by separate notification, to the extent you have signed up for such notifications.
8. Changes to these Terms and Conditions
   • We have the right to amend, alter, or supplement the present Terms and Conditions from time to time. The current version of the Terms and Conditions can be found on our website (https://inmed.ai/).
   • Any changes to these Terms and Conditions will usually be the result of new features being added to the In-Med Platform, or of changes in the legislation or applicable Regulations.
9. Documents governing the contractual relationship between you and us
   • The current version of the Terms and Conditions includes all provisions governing the contractual relationship between you and us. Older versions of the Terms and Conditions no longer apply to our contractual relationship and are entirely replaced by the current version.
10. Applicable legislation and jurisdiction
    • Our headquarters are in India. The agreement concluded on the basis of these Terms and Conditions is subject to the laws of the Union of India. Without prejudice to the above choice of jurisdiction, in the case of agreements between traders and consumers, the provisions of the law of the country in which the consumer is habitually resident and which – under the law of that country – may not be derogated from, may be applied in favor of the consumer if the trader:
    • pursues his/her commercial or professional activities in the country of the consumer’s habitual residence, or
    • such activities are in any way directed at that country or at several countries including that country, and the agreement falls within the scope of such activities.
    • The courts of India have the exclusive jurisdiction to settle any disputes arising in connection with, or because of, your use of the In-Med Platform.
11. Miscellaneous
    • You consent to us communicating with you by electronic means.
    • We may send you updates electronically to the email address you provided at the time you signed up for the In-Med Platform, or via other electronic means on the In-Med AI Studio when available.
    • The failure to enforce our rights must not be construed as a waiver of such rights.
    • Should any provision in these Terms and Conditions be or become void or unenforceable, the effectiveness of the remaining provisions will remain unaffected.
    • Only the contracting party itself has the right to enforce contractual provisions.
